(Terms of Use & Distance Service Agreement)

This agreement (“Agreement”) is entered into between:
Service Provider: Yaşar Turizm Sanayi ve Ticaret Limited Şirketi (Brand: Fethiye Lovers Travel Agency)
Customer/User: The individual who uses www.fethiyelovers.com, places a booking, or completes a purchase through the website.

Authorisation: Fethiye Lovers operates as an A-Group travel agency registered with TÜRSAB (Association of Turkish Travel Agencies) under Licence No: 3538.

• Service(s): Tourism-related services offered via the Website, including transfers, car rentals, tours/activities, ticketing, and related services.
• Booking: A request and/or purchase made by the Customer through online or other distance communication channels.
• Pre-Information: Key terms provided prior to purchase, including price, taxes, cancellation/refund rules, and similar details.
• Service-Specific Terms: Terms unique to a specific service (e.g., pick-up/drop-off rules, inclusions/exclusions, age/licence requirements, insurance, route, capacity, etc.).
This Agreement governs the Customer’s use of the Website and all bookings/purchases made through it. By completing a booking and/or payment, the Customer is deemed to have read, understood, and accepted this Agreement, the Pre-Information, and all related policies and Service-Specific Terms.
The Agreement is formed when the Customer completes the required steps on the Website and, where applicable, successfully completes payment. Booking and confirmation details may be provided to the Customer via email and/or other durable communication channels such as WhatsApp.
5.1 Transfers: Transfers are provided based on the date/time, route, passenger count, and other details confirmed in the booking. The Customer must promptly inform us of flight changes or relevant updates. For urgent requests made within 24 hours of the service time, additional confirmation by phone/WhatsApp may be required.
5.2 Car Rental: Car rental services are subject to Service-Specific Terms, including delivery/return procedures, driver requirements (age/licence), insurance coverage, fuel policy, traffic fines, and deposit requirements. These terms are presented during the booking stage, and the Customer confirms their acceptance.
5.3 Tours / Activities: Tour/activity content, duration, itinerary, inclusions/exclusions, meeting point, and participation requirements are provided in the booking details. Due to weather/sea conditions, safety requirements, or operational necessities, reasonable changes to the itinerary may be made.
5.4 Ticketing and/or Third-Party Services: Fethiye Lovers may act as an organiser and/or intermediary for third-party providers. In such cases, service delivery may also be subject to the provider’s rules and policies, which the Customer agrees to comply with.
Prices are displayed on the Website and/or during the booking process and, where applicable, are shown inclusive of mandatory fees and taxes. Available payment methods and any additional costs (e.g., commissions or bank charges) are disclosed during the payment step.
Customer requests to change the date/time, route, passenger count, or similar details are assessed based on service type, availability, and operational feasibility. If a change is not possible or results in additional costs, the Customer will be informed accordingly.
Cancellation and refund rules vary by service type and are governed by the Service-Specific Terms disclosed at the time of purchase and the Cancellation & Refund Policy page. Under distance sales regulations, the right of withdrawal may not apply to certain services provided on specific dates/periods (such as accommodation, transport, car rental, or leisure services). For passenger transport services, applicable consumer rights remain reserved in accordance with relevant legislation.
We are not liable for service disruptions arising from incorrect or incomplete information provided by the Customer. Where a third-party provider is responsible for the actual delivery of a service, we will provide coordination; however, liability for performance is assessed primarily under the third party’s rules and applicable law. The Customer is responsible for complying with safety rules and instructions. Any consequences arising from non-compliance are the Customer’s responsibility.
In cases of force majeure (including natural disasters, war, strikes, official authority decisions, severe weather/sea conditions, security risks, or system outages beyond control), services may be postponed, modified, or cancelled. In such cases, the parties will act in accordance with applicable legislation.
The Customer’s personal data is processed in accordance with applicable data protection laws (including KVKK) to provide services and fulfil legal obligations. Details are provided in the KVKK Privacy Notice and Cookie Notice published on the Website.
All content on the Website (including text, images, logos, and design) is owned by the Service Provider and/or its licensors. No content may be copied, reproduced, or distributed without prior written permission.
Customers may first submit complaints/requests through our official contact channels. Consumer disputes may be resolved before the relevant Consumer Arbitration Committees and Consumer Courts in accordance with applicable Turkish consumer legislation.
This Agreement becomes effective as of the date it is published on the Website. By using the Website and/or making a booking/purchase, the Customer confirms that they have read, understood, and accepted this Agreement.
